NEW ORLEANS – A man alleges his foot was broken at a Slidell facility because of a forklift.

Patrick Stewart filed a complaint on March 22 in the U.S. District Court for the Eastern District of Louisiana against International Paint LLC, a division of Akzo Nobel Coatings Inc., and Zurich American Insurance Co.

According to the complaint, the plaintiff alleges that on April 4, 2016, he was at defendant International's facility to pick up load of paint when a forklift rolled over his right foot, braking four bones. As a result of the accident, he alleges he incurred total damages of $128,100. The plaintiff holds International Paint LLC and Zurich American Insurance Co. responsible because defendant International's forklift operator allegedly operated the forklift at an excessive rate of speed.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally for damages complained herein, plus interest, costs of these proceedings and all other general and equitable relief. He is represented by Kevin C. Schoenberger of Law Office of Kevin C. Schoenberger in New Orleans and Morris H. Hyman of The Law Office of Morris H. Hyman in New Orleans.
