First BTS N. Carrollton alleges Rosebud Mid-City One breached sale agreement

NEW ORLEANS – A Florida buyer is alleged to have refused to close the transaction of a property.

First BTS N. Carrollton LLC filed a complaint on March 21 in the U.S. District Court for the Eastern District of Louisiana against Rosebud Mid-City One LLC alleging breach of purchase and sale agreement.

According to the complaint, the plaintiff alleges that on Nov. 3, 2016, plaintiff agreed to sell a certain property to defendant. The suit states that as a result of defendants' default, plaintiff has been damaged. The plaintiff holds Rosebud Mid-City One LLC responsible because the defendant allegedly refused to close the transaction and purchase the property as contemplated by the agreement and waived its obligations to renegotiate the purchase price.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, plus interest, costs, attorney's fees and all other legal and equitable relief. It is represented by Edward D. Wegmann, Graham H. Ryan and Allison B. Kingsmill of Jones Walker LLP in New Orleans.
