Man alleges MLM Remodeling LLC, N & T Improvements LLC owes unpaid overtime

NEW ORLEANS – A painter alleges his former employers failed to pay him for overtime work and has filed a class-action suit.

Santos Gomez, individually and on behalf of all others similarly situated, filed a complaint on March 17 in the U.S. District Court for the Eastern District of Louisiana against MLM Remodeling LLC, N & T Improvements LLC and Mykola Udych alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for the defendants for more than a year beginning in November 2015. He alleges he normally worked more than 40 hours a week for the defendants, but was never paid one-and-a-half times his hourly rate for all hours worked in excess of 40 in a workweek. The plaintiff holds MLM Remodeling LLC, N & T Improvements LLC and Udych responsible because the defendants allegedly paid him $110 per day and even if he worked in excess of 40 hours in any particular week, he was still paid $110 per day.

The plaintiff requests a trial by jury and seeks an order certifying the case as a collective action, award for all unpaid overtime wages due and owing, plus liquidated damages, attorneys’ fees and costs and such other general and equitable relief. He is represented by Roberto Luis Costales, William H. Beaumont and Emily A. Westermeier of Beaumont Costales in New Orleans.
