BATON ROUGE – A consumer is suing two debt collectors alleging false and deceptive representation.
Jonathan Raburn filed a complaint on March 17 in the U.S. District Court for the Middle District of Louisiana against Wiener Weiss & Madison and Community Management LLC alleging that they violated the Federal Fair Debt Collection Practices Act.
According to the complaint, the plaintiff claims that the defendants are attempting to collect an alleged debt. The plaintiff holds Wiener Weiss & Madison and Community Management LLC responsible because the defendants allegedly communicated with plaintiff without any notice that they were attempting to collect a debt, falsely represented the amount of the debt and attempted to collect a debt with a consumer that was represented by counsel.
The plaintiff requests a trial by jury and seeks damages, costs and reasonable attorney’s fees and such other and further relief as may be necessary, just and proper. He is represented by Nicholas M. Graphia of Law Office of Nicholas M. Graphia LLC in Baton Rouge.
