Omega Protein employee alleges he is owed maintenance and cure benefits

North Carolina resident accuses Omega Protein Inc. of negligence

NEW ORLEANS — A seaman is suing Omega Protein Inc., a vessel operator, citing alleged insufficient measures were taken to prevent injuries and unsafe work environment.

Vernon Nolan filed a complaint on April 3, in the U.S. District Court for the Eastern District of Louisiana against Omega Protein Inc. alleging that the vessel operator failed to  provide a safe place to work.

According to the complaint, the plaintiff alleges that, in April 22, 2014, he was working in the course and scope of his employment when he sustained injuries onboard the vessel owned by defendant and while it was offshore Louisiana. Plaintiff incurred medical expenses, lost earnings and lost earning capacity, pain and suffering. The plaintiff holds Omega Protein Inc. responsible because the defendant allegedly failed to provide a competent crew, failed to properly train its crew on how the operation should have been conducted and wrongfully failed to provide maintenance, cure or unearned wages.

The plaintiff requests a trial by jury and seeks damages in an amount to be determined at trial, plus costs, interest, punitive damages and reasonable attorneys’ fees and costs. He is represented by Steven J. Gordon of Gordon, Elias & Seely LLP in Houston.
