Bourbon Bandstand bouncer allegedly punched man, left him without medical help

NEW ORLEANS – A man was allegedly injured and left without help at a bar.

Jackie Leagon and Bryan Merrill filed a lawsuit against Promenade Entertainment LLC, doing business as Bourbon Bandstand, and David Battiste in Orleans Parish Civil District Court alleging intentional tort.

According to the complaint, Merrill visited Bourbon Bandstand on Nov. 6. The suit states that Merrill was escorted from the building by Battiste and other bouncers. The defendant allegedly punched the plaintiff in the face and left him lying in the street. The complaint states Merrill suffered from serious injuries and died Nov. 14.

The defendant is accused of assault, battery, excessive force, failing to aid the plaintiff and overall negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Aaron Broussard of Broussard & Hart LLC in Lake Charles.

The case has been assigned to Division J Judge Paula A. Brown.
