Cab driver alleges his auto collision damage claim with the federal government has not been settled

NEW ORLEANS – A cab driver alleges a National Guard truck struck his vehicle on Interstate 10 and a settlement offer has not been provided to him after he filed a claim.

Tewende Kiendrebeogo filed a complaint April 3 in U.S. District Court for the Eastern District of Louisiana against the Department of the Army, Department of Defense and the United States of America, alleging the government failed to comply with the Federal Tort Claims Act regulations.

According to the complaint, Kiendrebeogo filed a standard Form 95 with The Department of the Army, alleging general and special damages totaling $200,000 after a cab he was driving was hit by a National Guard truck June 12, 2015, in New Orleans. The suit says the form was received by the defendant June 17, 2016. 

More than 180 days have passed and Kiendrebeogo's claim has not been settled, the suit says. The plaintiff alleges the defendants have not made any settlement offer to the plaintiff's claim.

Kiendrebeogo seeks judgment for the full sum of $200,000, plus interest, costs of court and all other general and equitable relief. He is represented by attorneys Kevin C.
