NEW ORLEANS – A Hanville consumer alleges a debt collector has called her 400 times since she revoked her consent to receive calls.
Sheba Johnson filed a complaint on April 6 in the U.S. District Court for the Eastern District of Louisiana against Navient Solutions LLC alleging that the debt collector violated the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that after plaintiff instructed defendant to stop calling her cellphone on Dec. 27, 2016, she still received calls as many as 10 times in a single day and has received approximately 400 calls since that date.
The plaintiff holds Navient Solutions LLC responsible because despite plaintiff's request to stop calling her, defendant allegedly continued to place calls using an automatic telephone dialing system.
The plaintiff requests a trial by jury and seeks statutory damages of $500 for each and every negligent violation and $1,500 for each and every willful violation of the TCPA, court costs, witness fees and all other relief that the court deems appropriate.
