Man alleges Nereus Shipping failed to provide safe working environment

BATON ROUGE – A Baton Rouge man alleges he was injured when he was fueling a vessel because of a hard hat thrown by an employee.

Darry Lewis filed a complaint on April 7 in the U.S. District Court for the Middle District of Louisiana against Nereus Shipping and M/V Laconic alleging failure to provide a safe working environment.

According to the complaint, the plaintiff alleges that on June 21, 2016, he was fueling the M/V Laconic as an employee of John W. Stone Oil Distributor when defendants' employee threw a hard hat down from the vessel, striking plaintiff in the head, causing him serious injuries to his neck, back and shoulders. Plaintiff alleges he has suffered medical expenses, loss of earnings and pain and suffering. 

The plaintiff holds Nereus Shipping and M/V Laconic responsible because the defendants allegedly failed to provide adequate training to their crew members and failed to properly institute or to enforce policies and procedures that would have reasonably protected plaintiff.

The plaintiff seeks all damages reasonable under the premises, together with legal interest, costs of these proceedings and all other relief reasonable under the premises. He is represented by Eulis Simien Jr. and Jimmy Simien of Simien & Simien LLC in Baton Rouge.
