NEW ORLEANS – A Texas man alleges he was injured because of his exposure to cleanup agents and petroleum products during the clean up of the Deepwater Horizon spill.

Kevin Reece filed a complaint on April 11 in the U.S. District Court for the Eastern District of Louisiana against BP Exploration & Production Inc., BP America Production Co. and BP PLC, et al. alleging negligence.

According to the complaint, the plaintiff alleges that while working on a vessel involved in defendants' oil clean up from the Deepwater Horizon explosion, he was exposed to toxic petroleum products and cleanup agents that caused him to experience physical and medical injuries. He alleges he experienced coughing, shortness of breath, diarrhea, kidney problems and dizziness.

The plaintiff holds BP Exploration & Production Inc., BP America Production Co. and BP PLC, et al. responsible because the defendants allegedly failed to provide proper equipment and gear necessary to perform the job in a safe manner and failed to properly train and/or instruct and/or warn plaintiff of the dangers of being exposed the toxic chemicals.

The plaintiff requests a trial by jury and seeks exemplary and punitive damages, attorney's fees, litigation expenses and all other general and equitable relief. He is represented by Darleen M. Jacobs of The Law Offices of Darleen M. Jacobs in New Orleans.
