NEW ORLEANS – A Texas-based insurer claims an Orlando insurance company did not perform its obligations under a policy.

USAA General Indemnity Co., individually and as subrogee of Terrence R. Scott, filed a complaint on April 24 in the U.S. District Court for the Eastern District of Louisiana against Lighthouse Property Insurance Corp. alleging breach of contract.

According to the complaint, the plaintiff alleges that both parties insured Scott's home and real personal property and that the property was damaged by fire in February 2015. The suit states that the plaintiff paid $500,000 in satisfaction of the entire debt owed by both parties to their insured. The plaintiff holds Lighthouse Property Insurance Corp. responsible because the defendant allegedly failed to pay the agreed pro-rated share of the adjusted loss.

The plaintiff requests a trial by jury and seeks actual damages, costs of court and interest. It is represented by Jake P. Skaggs of Cozen O'Connor in Houston, Texas.
