BATON ROUGE – A carpenter has filed a class-action suit seeking to recover allegedly unpaid overtime wages from his former employers.
Oscar Valle filed a complaint on behalf of individually and on behalf of all others similarly situated filed a complaint on April 28 in the U.S. District Court for the Middle District of Louisiana against Beaurayne Builders LLC, Galindo Z Construction 8 LLC, Eldred Robert Jr. and Jose Galindo alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he was hired by the defendants in November 2016 and worked for five months. He alleges that while he was worked for the defendants, he was not paid at one-and-a-half times his regular hourly rate for all hours worked in excess of 40 per week. He also alleges that Galindo sent text messages to him using threatening and abusive language to coerce him from prosecuting this case.
The plaintiff holds Beaurayne Builders LLC, Galindo Z Construction 8 LLC, Robert Jr. and Galindo responsible because the defendants allegedly treated plaintiff as exempt from the FLSA’s overtime requirements and paid him at a day rate for all worked performed.
The plaintiff requests a trial by jury and seeks an order certifying this case as a collective action, award for all unpaid overtime wages, plus punitive damages, attorneys’ fees, costs and interest and all other relief as the court deems equitable.
