African-American employee accuses Bay LTD, Berry GP of discrimination

NEW ORLEANS – An African-American woman residing in Assumption Parish alleges her former employers subjected her to discrimination and harassment.

Dana Jupiter filed a complaint on May 4 in the U.S. District Court for the Eastern District of Louisiana against Berry Contracting LP, doing business as Bay LTD and Berry GP Inc. alleging that they violated Title VII of the Civil Rights Act.

According to the complaint, the plaintiff was employed by the defendants as a tool room manager/foreman beginning in 2014. She alleges that during her employment, she was subjected to repeated harassment and discrimination and that she reported the treatment to human resources. The suit states she was terminated on May 6, 2015. 

The plaintiff holds Berry Contracting LP and Berry GP Inc. responsible because the defendants allegedly subjected her to race discrimination, harassment, retaliation and termination because of her race and/or sex and because of her complaints.

The plaintiff requests a trial by jury and seeks judgment in her favor, for damages in an amount to be determined at trial, plus interest, costs and all further relief as the court may deem just and proper. She is represented by Eric R. Nowak and Shirin E. Harrell of Harrell & Nowak LLC in New Orleans.
