NEW ORLEANS – A manual laborer has filed a class-action suit against a Morgan City business and a Houma business over allegations of unpaid overtime.

Juan Pineda filed a complaint on May 11 in the U.S. District Court for the Eastern District of Louisiana against Superior Labor Services Inc. and Conrad Industries Inc. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed by the defendants at shipyards in St. Mary Parish from December 2013 to July 2014. The plaintiff alleges that he suffered damages for not being paid at a rate of one-and-a-half times his regular hourly rate for all hours worked in excess of 40 hours a workweek.

The plaintiff requests a trial by jury and seeks an order certifying this case as a collective action, award for all unpaid overtime wages, plus interest, liquidated damages, attorneys’ fees and costs and all other general and equitable relief as the court deems equitable. He is represented by Roberto Luis Costales, William H. Beaumont and Emily A. Westermeier of Beaumont Costales LLC in New Orleans.
