Disabled woman claims Life Insurance Co. of North America paid incorrect amount

NEW ORLEANS – A Mississippi woman alleges her disability benefit payments were not correctly calculated.

Frances T. Shaw filed a complaint on May 12 in the U.S. District Court for the Eastern District of Louisiana against Life Insurance Co. of North America alleging that the plan administrators violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she is disabled and that the defendant has paid her an incorrect amount for short and long-term disability benefits. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly miscalculated plaintiff's benefits and unlawfully denied such benefits for which she is entitled to.

The plaintiff seeks payment for all benefits due, plus interest, attorney fees and costs and for all other relief as the law may provide. She is represented by Reagan L. Toledano and James F. Willeford of Willeford & Toledano in New Orleans.
