Man alleges he is disabled because of PTSD, claims benefits were wrongfully terminated

NEW ORLEANS – A former employee of D&S Marine Services alleges that he is still disabled and that his benefits were wrongfully terminated.

Timothy Billiot filed a complaint on May 15 in the U.S. District Court for the Eastern District of Louisiana against Aetna Life Insurance Co. alleging that the claims administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff became disabled because of post-traumatic stress disorder and acute anxiety disorder in April 2016. The suit states he initially received disability benefits and that the benefits were terminated by the defendant in January. 

The plaintiff holds Aetna Life Insurance Co. responsible because the defendant allegedly unlawfully terminated plaintiff's long-term disability income benefits and failed to provide a full and fair review of his claim.

The plaintiff seeks a declaration that he is entitled to long-term disability benefits, costs of this action and attorneys’ fees and all other relief as the court deems just and reasonable. He is represented by David C. Pellegrin Jr. of Waitz & Downer in Houma.
