NEW ORLEANS – A New Orleans consumer claims a disputed debt on her credit report cost her pre-approval for a mortgage loan.
Hayley Graham filed a complaint on May 16 in the U.S. District Court for the Eastern District of Louisiana against Southwest Credit System LP alleging that the debt collector violated the Fair Debt Collection Practices Act.
According to the complaint, the defendant is attempting to collect a debt to AT&T Uverse from the plaintiff, which she alleges she does not owe. As a result of defendant's actions, plaintiff's pre-approved mortgage loan allegedly was denied.
The plaintiff holds Southwest Credit System LP responsible because the defendant allegedly refused to remove or edit plaintiff's alleged debt and failed to note the debt as disputed.
The plaintiff seeks actual and statutory damages, costs and attorney’s fees and all other relief that the court deems appropriate. She is represented by Samuel J. Ford of Scott, Vicknair, Hair & Checki LLC in New Orleans.
