Mother accuses Forterra Pipe and Precast of negligence in death of son

NEW ORLEANS – A mother is seeking damages claiming that her son died due to the negligence of his Orleans Parish-based employer.

Lerner Davis, individually and on behalf of her deceased son, Lester Cook, filed a lawsuit May 18 against Forterra Pipe and Precast LLC in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff's son was employed by the defendant and sent to a job Feb. 2. The suit states that the defendant was negligent in its responsibility to protect Cook and failed to fix a manhole that was uncovered. The plaintiff's son fell into the manhole and suffered major injuries, which eventually led to his death.

The defendant is accused of gross negligence.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys George B. Recile and Barry W. Sartin of Chehardy, Sherman, Williams, Murray, Recile, Stakelum & Hayes LLP in Metairie.

The case has been assigned to Division J Judge Cherrell S. Taplin.
