NEW ORLEANS – A manual laborer who worked on a University Medical Center in New Orleans project alleges his former employer only paid him straight time for overtime hours that he worked.
Cesar Rodriguez, individually and on behalf of all others similarly situated, filed a complaint on May 24 in the U.S. District Court for the Eastern District of Louisiana against Allan Spear Construction LLC alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that during his employment with defendant from February 2016 to February 2017, he was not paid proper overtime compensation. The plaintiff holds Allan Spear Construction LLC responsible because the defendant allegedly never paid plaintiff one-and-half times his hourly rate for all hours worked in excess of 40 in a workweek.
The plaintiff requests a trial by jury and seeks unpaid wages, interest, liquidated damages, attorneys’ fees and costs and such other relief as the court deems equitable. He is represented by Roberto Luis Costales, William H. Beaumont and Emily A. Westermeier of Costales Law Office in New Orleans.
