Performance Contractors Inc. alleged to have not informed employee of FMLA rights

LAKE CHARLES – A Lake Charles man alleges his Baton Rouge employer terminated him after missing work to care of his daughter.

Christopher Colvin filed a complaint on May 25 in the U.S. District Court for the Western District of Louisiana, Lake Charles Division against Performance Contractors Inc. alleging that the former employer violated the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that on Jan. 24, he was terminated from his employment for missing work to take his daughter for medical treatment and was verbally told that he was eligible for rehire after one month. Since then, the suit states that the plaintiff was not rehired and is currently receiving unemployment benefits of $451 per week. 

The plaintiff holds Performance Contractors Inc. responsible because the defendant allegedly failed to inform him of his rights under the Family and Medical Leave Act.

The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, reimbursement of medical expenses, reinstatement and promotion and all further relief as the court deems appropriate. He is represented by James E. Sudduth III of Sudduth & Associates LLC in Lake Charles.
