Happy Kids Enterprises Inc. alleges insurer still owes more than $180,000 for fire claim

NEW ORLEANS – A licensed day care facility alleges its insurer failed to timely and adequately pay the complete amount of damages sustained after a fire at the property.

Happy Kids Enterprises Inc. and Dr. Mark Irabor filed a complaint on June 12 in the U.S. District Court for the Eastern District of Louisiana against Granite State Insurance Co. alleging breach of duty and other counts.

According to the complaint, the plaintiffs allege that on Feb. 12, the Happy Kids’ structure suffered significant losses and damages caused by fire. After all payments, defendant allegedly still owes plaintiffs the total amount of $184,905.46. The plaintiffs hold Granite State Insurance Co. responsible because the defendant allegedly failed to timely and adequately pay for the complete amount of damages.

The plaintiffs payment for all damages, plus penalties, attorneys' fees, costs and interest and all other relief that the court may deem fair and equitable. They are represented by J. Douglas Sunseri and Richard Wolff of Nicaud & Sunseri Law Firm LLC in Metairie.
