River Oaks Hospital allegedly failed to prevent sexual assault

GRETNA — A woman is suing River Oaks Inc. d/b/a River Oaks Hospital for allegedly failing to take safety measures to prevent her from being sexually assaulted.

The plaintiff filed a suit on June 26 in the 24th Judicial District Court, alleging that the defendant was negligent.

According to the claim, the plaintiff claims that she was required to stay at the hospital on July 2, 2016 and allegedly was sexually abused by an unknown patient. The first incident allegedly occurred when the male attacker tried to fondle her breast. The plaintiff allegedly screamed and was taken away from the man. But later that day, she allegedly woke up to see the defendant staring at her. The unknown man allegedly continued to stalk her during her stay at the hospital.

The defendant is accused of negligence for allegedly allowing the plaintiff to be sexually abused and harassed, failing to discipline or remove the attacker and for allegedly breaching its duty to keep the plaintiff from harm.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Myles Steib and Benjamin Perkins of Gardner & Steib Attorneys in Metairie.
