NEW ORLEANS – Two assistant managers for restaurant franchise operators allege that they were not compensated at the correct rate for overtime work and have filed a class-action suit.

Dominique Hankton and Willie Ray Davis, individually and on behalf of all others similarly situated, filed a complaint on July 1 in the U.S. District Court for the Eastern District of Louisiana against TACI Investments Inc., Kamal P. Singh, Sanjay Mehra, Mohammad H. Tily and Refeick Ali alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs were assistant managers for the defendants' KFC restaurants in Baton Rouge, New Orleans and Gonzales. The plaintiffs holds TACI Investments Inc., Singh, Mehra, Tily and Ali responsible because the defendants allegedly failed to pay them one-and-one-half times their regular hourly rate for all hours worked over 40 per week. Instead, defendants allegedly paid them straight time.

The plaintiffs request a trial by jury and seek compensation for all unpaid overtime wages, liquidated damages, interest, costs, attorneys’ fees and all further relief as the court deems just and proper. They are represented by Kenneth C. Bordes of Kenneth C. Bordes Attorney at Law LLC in New Orleans and Gordon E. Jackson, J. Russ Bryant and Paula R. Jackson of Jackson, Shields, Yeiser, & Holt Attorneys at Law in Memphis, Tennessee.
