Orleans Parish residents claim check was not properly endorsed

NEW ORLEANS – Orleans Parish men are seeking damages claiming a check was not endorsed.

Christopher Galliano and Bradley Egenberg filed a lawsuit against Ditech Financial LLC, formerly known as Green Tree Servicing LLC, in Orleans Parish Civil District Court alleging the defendant failed to properly endorse a check after his property was destroyed in a fire.

According to the complaint, Galliano is the owner of the property in New Orleans that burned down in a fire. The suit states that the plaintiff received a check May 12 from the United Services Automobile Association for $262,395.32 as a settlement. The defendant was requested to endorse the check but has failed to do so, resulting in interest charges to the plaintiff after he took out a loan to make repairs to the property, the complaint states.

The defendant is accused of negligence, failing to respond in a timely manner and overall inconvenience to the plaintiff.

The plaintiffs seek all reasonable damages, court costs, attorney fees and all appropriate relief. They are represented by Gerald Wasserman of Gerald Wasserman LLC in Metairie.

The case has been assigned to Division G Judge Robin M. Giarrusso.
