Marrero Walgreens allegedly gave man wrong medication

Medical malpractice 01

GRETNA — A Jefferson Parish couple claims that a prescription was filled incorrectly by the Walgreens in Marrero for two years.

Eddie Painter and Angelle Painter filed a suit on Sept. 19 against Walgreen Louisiana Company Inc., John Doe Pharmacist and ABC Insurance Co. in the 24th Judicial District Court alleging negligence.

According to the claim, the plaintiff is seeking damages for the incident, which began in September 2015. The suit states that the plaintiff brought a prescription for Sulfasalazine to the Walgreens at 2570 Barataria Blvd. in Marrero. The plaintiff continued to bring his prescription to this Walgreens until 2017, when he allegedly was told that the pharmacist had been incorrectly providing Sulfadiazine instead.

The defendants are accused of negligence through failing to perform the duties required, failing to warn of the danger at hand, failing to exercise appropriate care and overall negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Max M. Chotto in Gretna.

The case has been assigned to Division B Judge Cornelius E. Regan.
