Interstate bridge repair work allegedly went unpaid

Contract 04

NEW ORLEANS – A subcontractor was allegedly not paid what they were owed for work completed on a major interstate bridge.

Waskey Services LLC filed a lawsuit on Nov. 22 against Royal Bridge Inc., and Fidelity and Deposit Company of Maryland in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, the plaintiff was subcontracted by the defendant to complete a construction job, which involved patching a highway bridge deck on Interstate 10 and Interstate 610. The suit states that the plaintiffs' employees were working in a dangerous and highly trafficked area, which caused their work to be completed more slowly than they had anticipated. In addition, police had to be paid to help maintain the safety of the site. The suit states that the defendants failed to pay the plaintiff what they were owed and reduced the overall payment issued to the plaintiff based on the amount paid to the police for traffic control.

The plaintiff claims that it is owed $32,258 plus interest.

The defendant is accused of breach of contract and sums due.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The company is represented by Lloyd N. Shields, Andrew G. Vicknair and Ashley B. Robinson of Shields Mott LLP in New Orleans.

The case has been assigned to Division E Judge Clare Jupiter.
