Construction company seeks damages for defective building

GRETNA – A construction company claims in a lawsuit filed Dec. 22 that it was sold a defective building.

APC Construction LLC filed a suit against Harvey Properties LLC and Barriere Construction Co. LLC in the 24th Judicial District Court alleging negligence and breach of contract.

According to the claim, the plaintiff is seeking damages for an incident that took place Dec. 22, 2016. The suit states the plaintiff agreed to purchase a property for $1.725 million. However, following the purchase, the plaintiff discovered there was a defect to the property which caused water damages to occur.

The defendant is accused of breach of contract through failing to fully disclose the true state of the property and selling a defective property while fully aware of its state.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by James J. Reeves of Melchiode Marks King LLC in New Orleans.

The case has been assigned to Division D Judge Scott Schlegel.

The 24th Judicial District Court Case No. is 778978.
