Injured streetcar passenger claims RTA driver accelerated too fast

NEW ORLEANS – A woman is seeking damages claiming that she was injured when a streetcar driver accelerated too fast.

Kimberly Prestenbach filed a lawsuit on Jan. 23 against Transdev Services Inc., dba Veolia Transportation Services Inc., dba Regional Transit Authority; and Jane Doe in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff is seeking damages for an incident that took place on Feb. 5, 2017 when the plaintiff was boarding an RTA Streetcar. The plaintiff allegedly was injured when the unnamed driver of the streetcar closed the doors abruptly, hitting the plaintiff, then driving off at a fast speed, which caused the plaintiff to fall and be injured.

The defendant is accused of negligence and failing to take the appropriate level of care.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Pierce A. Hammond II of Hammond Law Firm LLC in New Orleans.

The case has been assigned to Division D Judge Nakisha Ervin-Knott.
