Crew member accuses former employer of negligence, unpaid wages

GRETNA –– An injured seaman brought a lawsuit against his former employer.

Carnell Pendleton filed a complaint on Sept. 24 in the 24th Judicial District Court against Belle Chasse Marine Transportation Inc.

According to the complaint, the plaintiff was worked on the defendant's boat as a crew member. In February, the boat ran aground and the plaintiff was thrown down. He injured his head and elbow, the complaint states. He seeks damages for his injuries under the Jones Act. 

The plaintiff also alleges the defendant did not pay him overtime wages totaling more than $23,000.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Robert J. Caluda of the Caluda Law Firm in Belle Chasse.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
