Home buyer seeks damages after oak tree dies

GRETNA – A man is seeking damages after a tree died in his yard.

Ryan J. Matherne filed a complaint on Oct. 23 in the 24th Judicial District Court against Great Southern Real Estate Development LLC. 

According to the complaint, the plaintiff is seeking damages for an incident that took place at the property on 1400 Ridgelake Drive in Metairie. The suit states the plaintiff purchased the home at the address listed due, in part, to the live oak in the front yard that appeared to be healthy. The suit states that after the plaintiff moved in on August 30, 2017, he noticed the color started to brown and that the tree was not healthy. The suit states the plaintiff is seeking damages due to the loss of the tree and the damages he incurred by having to have it removed from his yard.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Daniel Cavell of Morvan & Cavell APLC in Thibodaux.

The case has been assigned to Division P Judge Lee Faulkner Jr.
