Shopper claims dangerous cart caused her to fall in a Winn-Dixie

GRETNA – A woman is seeking damages for a fall that she says was caused by a dangerous cart in a Winn-Dixie.

Lucille Every filed a complaint on Dec. 26 in the 24th Judicial District Court against Winn-Dixie Stores Inc., Winn-Dixie Montgomery LLC, Tasman Group PR Inc. and Louisiana Farmer's Insurance LLC.

According to the complaint, the plaintiff is seeking damages for negligence and failure to remedy a dangerous situation. The suit states that on Dec. 23, 2017, the plaintiff was a customer at the Winn-Dixie at 2112 Belle Chasse Highway in Gretna. The plaintiff was allegedly caused to trip and fall on a metal bar that was on the back of the defendant's shopping cart, which was dangerous and unnecessary.

The defendant is accused of negligence and failure to remedy a dangerous situation.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Zachary Christiansen of The Bowling Law Firm in New Orleans.

The case has been assigned to Division O Judge Danyelle Taylor.
