Shopper's estate alleges she tripped on a poorly placed rug in a Winn-Dixie

GRETNA – A woman's estate alleges she was caused to fall at a Winn-Dixie due to a dangerous positioning of a rug.

The estate of Emma L. Davis filed a complaint on Jan. 14 in the 24th Judicial District Court against Winn-Dixie Montgomery Inc.

According to the complaint, the plaintiff is seeking damages for an incident that took place on Jan. 16, 2018 when the plaintiff was walking into the Winn-Dixie at 5901 Airline Drive in Metairie. The lawsuit claims she was caused to fall as a result of an entry rug that caught her foot and tripped her.

The defendant is accused of negligence and failure to maintain to maintain a public setting.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Max Chotto in Gretna.

The case has been assigned to Division C Judge June Berry Darensburg.

The 24th Judicial District Court Case No. is 791206.
