Lawsuit seeks damages from an allegedly negligent driver

GRETNA – A woman is seeking damages through a lawsuit that claims her car was struck by a negligent driver who pulled into her lane.

Kelly Smith filed her complaint against Bart P. Berteau, Ardent Services LLC and Continental Casualty Company on Jan. 29 in the 24th Judicial District Court. According to the lawsuit, the plaintiff is seeking damages for an incident that took place on February 7, 2018, when Smith was driving a 2004 Toyota Corolla. The defendant, who was exiting a driveway, allegedly tried to cross over to the plaintiff's lane of traffic and struck Smith's vehicle, causing injuries and damages to the plaintiff.

The defendant is accused of negligence and failure to drive a car responsibly. The plaintiff is seeking all reasonable sums due, attorney fees and court costs. Smith is represented by Robert J. Caluda of The Caluda Law Firm in Metairie.


The case has been assigned to Division B Judge Cornelius E. Regan.
