Property owners say Terrebonne wetlands pipelines, canals and right-of-ways fall further into disrepair

NEW ORLEANS - A February petition in the Terrebonne Parish District Court requests two pipeline companies stop neglecting their pipelines and canals in Terrebonne Parish.

The petition comes from plaintiff Henican Terrebonne Property LLC, which owns coastal wetlands throughout the parish. Defendants Tennessee Gas Pipeline Company LLC and Gulf South Pipeline Company LP inherited pipeline companies that entered into agreements with the plaintiff in the 1950s to lay and maintain gas pipelines and canals in the wetlands. 

The petition accuses the defendants of allowing the pipelines and canals to fall into a state of neglect, causing significant erosion and ecological upset. 

Under Louisiana Civil Code, the defendants are responsible for fixing the damages caused by their neglected canals and pipelines, according to the plaintiff. 

The petition accuses the defendants of violating the Louisiana Unfair Trade Practices Act, and the plaintiff requests the court order immediate action from the defendant and award damages deemed appropriate. 

The plaintiff is represented by Fishman Haygood LLP of New Orleans. 

The defendant removed the case to New Orleans federal court in March.
