Man trips coming out of gas station porta potty, files lawsuit

MONROE - A man claims to have fallen while going to use an outside bathroom at a truck stop and becoming injured. 

Lorenzo Perkins, Jr. and Pamela D. Bradley Perkins filed a complaint in May in the Parish of Madison Sixth Judicial District Court against Sheffield Rentals, Inc., Love's Travel Stops and Country Stores, Inc., ABC Insurance Co., and Def Instance Co. for negligence. The defendants removed the case to federal court on June 1.

According to the complaint, Perkins was outside a Love's Travel Stops and Country Stores located at 227 Highway 65 South, Tallulah, Madison Parish, Louisiana, to use the restroom. Portable restrooms were set up outside the location for the public's use. 

Perkins went to use the outside accommodations and allegedly fell while exiting the restroom, which resulted in him sustaining injuries. Perkins attests that it was the negligence of Love's Travel Stops and Country Stores, and the portable restroom owner Sheffield Rentals, for failure to warn of hazard, among other allegations. 

Perkins seeks damages plus costs for any experts he may have to hire, attorneys fees, punitive damages and cost of suit.
