LAFAYETTE - Nara Uch filed a federal complaint on September 10 in the Western District of Louisiana against Sunbelt Rentals, Inc. and CH Steel Solutions, Inc. for personal injury.
According to the complaint, on Jan. 6, 2021, Uch was in an industrial accident in Broussard. Prior to the incident, Phoenix Metals purchased a large industrial-size cantilever shelving/racking system from CH Steel which was to be installed at Phoenix Metals’ facility.
CH Steel engaged the services of Loughrea Associates to dismantle and remove the old racking system and to install the new racking system and Uch, as an employee of Loughrea, was participating in the dismantling and removal of the previous racking system and to assist in the installation of the new racking system at the Phoenix Metals facility.
Sunbelt had provided the forklift to the Loughrea team in order to do the job. On Jan. 5, 2021, a bearing had broke on the forklift and on Jan. 6, Sunbelt was unable to fix it or provide another forklift similar in size, so it delivered a replacement forklift to the job site which was shorter than the forklift which had broken on the day prior, the suit claims.
While Uch was operating the forklift, the racking system that he and the Loughrea team were attempting to dismantle collapsed and fell on the forklift he was operating causing traumatic injury, the suit says.
