Million-dollar lawsuit filed over amputated foot

NEW ORLEANS - Josephine Brown, wife of Charles Brown, filed a federal complaint on October 20 in the U.S. District Court Eastern District of Louisiana against the United States.

According to the complaint, Charles Brown is a veteran who has received treatment for years at the Veteran’s Administration Medical Center and rehabilitation facility in New Orleans and Southeast Louisiana Veterans Health Care System of New Orleans. 

In 2017, Charles Brown was a long-time diabetic patient of Dr. Marcia Davila and presented to the VA Urgent Care Clinic on November 21, 2017, with an infected sore or blister on his foot, the suit says.

No oral or IV antibiotics were given to Brown and he was released, the suit says. On November 25, 2017,  Brown’s condition was worsening and he was told to go to University Medical Center, where he was treated with Bactrim and discharged, the suit says. On November 27, 2017, due to the worsening condition of his foot and fever, he then again sought treatment at VA Urgent Care and VA Hospital and was treated by Dr. Greg Baquet, Monica M. Wright and Delaney Davis.

They evaluated Brown and then advised he would need to be transferred to Tulane University hospital for an infection in his foot, the suit says. Brown was transferred and underwent an amputation of the lower part of his leg as a result of the infection that was improperly treated, the suit says.

Josephine Brown seeks $1,000,000 plus interest and cost. Josephine Brown is represented by Patrick H. Hufft.
