The program will present an overview of the new “Guidance for Department Attorneys Regarding Student Loan Bankruptcy Litigation” issued by the Department of Justice in November 2022 relating to the standardization of U.S. Attorney approach litigation regarding student loan discharge litigation in bankruptcy courts and discussion regarding how the new guidance differs from the current Brunner case law. Additionally, the program will include an overview of the process and practical pointers related to the preparation, filing, and prosecuting a student loan discharge adversary complaint in bankruptcy. Finally, the program will include practical suggestions, useful forms, and analytical tools to assist in the evaluation of potential clients and the chances of successfully obtaining discharge of student loan debts.
