NEW ORLEANS – Intracoastal Tug and Barge Company has filed a negligence lawsuit against Magnolia Fleet and the M/V Louise following a boat collision that caused more than $165,000 in damages.
Intracoastal Tug and Barge Company filed the lawsuit in federal court against Magnolia Fleet and the M/V Louise, her engines, tackle, appurtenances and tow (in rem).
According to the lawsuit, on June 15, 2023, the M/V REPOSE, which is owned and operated by Intracoastal Tug, was struck in a collision with the M/V LOUISE. The plaintiff alleges that the captain of the M/V REPOSE attempted multiple times to communicate with the M/V LOUISE to prevent the collision, but their efforts went unanswered, resulting in the collision that caused significant damage to the M/V REPOSE.
Intracoastal Tug asserts that the collision was exclusively due to the negligence of Magnolia and the M/V LOUISE, citing several instances of unseaworthiness, inadequate equipment, and negligent navigation. The plaintiff is seeking $166,502.81 in damages for repair costs and lost charter hire as well as other relief.
