Patron sues Home Depot for injuries

NEW ORLEANS — A Louisiana man is suing The Home Depot after he was injured while visiting a store.

Javier Zapata was at The Home Depot in Covington on May 31 when he was injured, according to a complaint filed Oct. 10 in U.S. District Court for the Eastern District of Louisiana.

Zapata claims while he was unloading purchases, his cart rolled on an unmarked and dangerous slope, causing him to fall.

The impact resulted in significant injuries, including brain bleeds, a broken nose and damage to his arm, knee,and back, according to the suit.

Zapata claims he required extensive medical treatment, including surgery and ICU admission because of the injuries. He claims he continues to face ongoing pain, hindering his daily activities and preventing him from enjoying a normal life. 

The Home Depot's failure to secure the area, provide warnings and ensure customer safety constituted negligence, leading to Zapata's injuries, the complaint alleges.

Zapata claims he suffered physical and mental pain and suffering and anguish; loss of enjoyment of life; medical expenses; and other losses.

Zapata is seeking compensatory damages. He is represented by M. Suzanne Montero, J. Jacob Chapman, Meghan E. Carter and Graham H. Williams of Sternberg, Naccari & White in New Orleans.
