Man sues former employer for injuries while aboard ship

NEW ORLEANS — A man is suing his former employer after he was injured while working aboard a ship.

Zachary T. Eastwood, while working aboard the M/V Noble Valiant for Noble Drilling, suffered severe injuries to his neck, back, face and other body parts in an accident on July 28, according to a complaint filed Oct. 13 in U.S. District Court for the Eastern District of Louisiana.

Under the General Maritime Law, the company had an absolute and nondelegable duty to provide Eastwood with maintenance and cure benefits from the date he became unfit for duty until maximum recovery was achieved, according to the suit.

Eastwood claims due to the accident, he was rendered unfit for duty and remains unable to return to work as a seaman.

Eastwood claims the defendants breached the legally imposed duty of reasonable care owed by the defendant to the plaintiff and failed to provide a reasonably safe place to work.

The defendant failed to provide the minimum safety requirements and failed to provide adequate personnel for the job in question, according to the suit.

Eastwood is seeking compensatory and punitive damages. He is represented by Timothy J. Young, Tammy D. Harris, Megan C. Misko and Joseph B. Marino III of the Young Firm in New Orleans.
