Ameropa North America sues cargo companies for $121,000 discrepancy

NEW ORLEANS – Ameropa North America has filed a lawsuit accusing cargo carriers of negligence and breach of contract after a shipment was delivered with more than $100,000 worth of cargo allegedly missing.

Ameropa North America filed a lawsuit in federal court against the M/V AMALEA, along with Mayflower Marine Ltd. and Allseas, Inc., citing allegations of negligence, breach of contract, and unseaworthiness of the M/V AMALEA.

According to court documents, Ameropa is based in Tampa, Florida and claims to be the owner/consignee of the cargo in question. The M/V AMALEA is an ocean-going bulk carrier vessel owned and operated by Mayflower Marine Ltd. and Allseas, Inc.

The lawsuit alleges that on September 22, 2022, the M/V AMALEA took delivery of cargo consisting of 17,416.460 metric tons of granular trisodium phosphate (TSP) at the Port of Antonina, PR, Brazil, for transportation to the Port of New Orleans. The lawsuit alleges that upon arrival at the Port of New Orleans, the cargo was found to be short by approximately 224 metric tons.

Ameropa claims to have sustained a financial loss of $121,465.16, along with survey fees, expenses, costs, and interest, due to the cargo discrepancy.

Ameropa is seeking compensatory damages along with the issuance of a warrant for the arrest and seizure of the M/V AMALEA, and an order for the defendants to appear in court and pay for the losses and damages sustained. The plaintiff is being represented by Philip S. Brooks Jr. and Ronald J. Kitto of Brooks Gelpi Haasé in New Orleans.
