A Louisiana man says the 2024 Jeep Grand Cherokee he purchased was defective.
Jamie C. Breckenridge filed his lawsuit January 8 in federal court against FCA US.
In the complaint, Breckenridge claims shortly after purchasing the vehicle from Ralph Sellers Jeep Chrysler Dodge on December 7, 2023, he discovered numerous defects in its materials and workmanship. He is seeking a rescission of the sales contract under Louisiana Civil Code Art. 2545, which provides remedies for buyers when sellers knowingly sell defective goods.
The plaintiff claims that FCA knew about the defects but failed to disclose them. He is suing for the return of the purchase price with interest from the time it was paid, reimbursement of reasonable expenses related to the sale and preservation of the vehicle, damages, and reasonable attorney fees.
The sales price of the Grand Cherokee was $73,534.70. In addition to this amount, Breckenridge is seeking non-pecuniary damages of $50,000 for aggrieved feelings due to FCA's alleged failure to repair the vehicle within a reasonable time.
