Maxine Thomas sues Housing Louisiana Now for breach of contract

Maxine Thomas has filed a lawsuit against Housing Louisiana Now, L.L.C., Tracy F. Robinson, Master Builders & Contractors, L.L.C., Richard J. Mithun, Dean's Air Condition & Heating, L.L.C., and Dean Walters in the Court of Appeal Fourth Circuit with case ID 2023-CA-0296. The lawsuit pertains to a breach of contract for repair work on her home that was severely damaged by tornadoes in 2017. The court case was filed on March 21, 2024.

Thomas entered into a contract with Master Builders & Contractors (MBC) on February 12, 2017, for the repair of her home amounting to $181,517.60 - the value of her insurance loss proceeds. However, Housing Louisiana Now (HLN) and MBC decided to collaborate on the project with HLN as the general contractor and MBC as a subcontractor. This led to a new contract between Thomas and HLN signed on March 13, 2017.

The initial portion of the insurance proceeds amounting to $83,597.03 was issued by Thomas' mortgage company to both Thomas and HLN which was then endorsed by Thomas and given to HLN. However, Tracy Robinson (manager of HLN) decided not to proceed with the project due to cost concerns and endorsed the check over to MBC without informing Thomas.

Thomas is seeking judgment against defendant HLN for breach of contract due to nonperformance, defective performance and delay in performance amounting to $83,597.03. The trial court ruled in favor of plaintiff Maxine Thomas dismissing all other claims with prejudice.
