Freight conductor blames rail company for foot injury

A freight conduct blames his employer for work injuries to his foot.

Lawrence Smith filed his lawsuit in federal court against Alabama Great Southern Railroad Company, also known as Norfolk Southern Railway Co., for injuries sustained on the job.

According to the complaint, Smith was working at AGS's Oliver Yard on August 5, 2023, when he suffered a foot injury resulting in peripheral neuropathy. He claims the injury occurred when a target on the East Track 12 switch struck his right foot while he was riding onboard an auto rack car ladder step pulling out of East Track 11.

Smith accuses AGS of negligence and failing to provide a safe workplace. He claims the company did not provide safe working conditions or proper equipment and failed to plan switching movements safely to avoid injury.

He is seeking damages for personal injuries, lost wages, fringe benefits and unpaid medical expenses.
