In the United States District Court, Eastern District of Louisiana, plaintiff Toshika M. Barnes has filed a lawsuit against Ochsner Clinic Foundation. The case ID is 2:24-cv-00911-SSV-EJD and was filed on April 11, 2024. The lawsuit alleges workplace discrimination based on race, age, and disability.

Barnes, an African-American female over thirty years old, was employed by Ochsner Clinic Foundation from July 9, 2012. She claims that she was denied promotions due to her race, age, and disability accommodation needs. In October and September of 2022, Barnes applied for a senior position but was passed over in favor of younger Caucasian nurses.

The plaintiff also alleges retaliation after filing an EEOC complaint. She claims that she has been subjected to intimidation by management and unequal treatment during performance reviews.

Barnes is seeking redress for alleged violations of the Americans with Disabilities Act of 1990 and Title VII for Age, Race, Disability, and Retaliation under 42 U.S.C. 2000e.
