Kevin Booker sues Southeast Louisiana Flood Protection Agency for alleged violation of Americans with Disabilities Act

Kevin Booker has filed a lawsuit against the Southeast Louisiana Flood Protection Agency (SLFPA) in the United States District Court for the Eastern District of Louisiana, under the case ID 2:24-cv-00918-DJP-KWR on April 12, 2024. The plaintiff alleges that SLFPA violated the Americans with Disabilities Act (ADA) by not hiring him due to his history of disability.

Booker applied for a Maintenance Repairer II position at SLFPA in December 2021 and was given a conditional offer of employment pending a pre-employment drug screen and physical examination. During his physical examination in January 2022, he disclosed a previous back injury from an auto accident six years prior but stated that it did not interfere with his work. Despite passing the physical and providing a note from his personal physician stating he required no work restrictions or accommodations, Booker's job offer was not confirmed.

The plaintiff is seeking damages and other legal and equitable relief for this alleged violation of ADA. He asserts that SLFPA imposed a discriminatory policy against hiring applicants who need accommodations, denying him equal opportunities under the ADA.
