Plaintiff Alleges Negligence Against Major Corporations Over Health Issues From Oil Spill

A new lawsuit has been filed in the United States District Court for the District of Delaware, alleging significant health impacts from the BP Deepwater Horizon Oil Spill. The complaint, lodged by Travis Curry on July 26, 2024, targets BP Exploration & Production Inc., BP America Production Co., Transocean Holdings LLC, Transocean Deepwater Inc., Transocean Offshore Deepwater Drilling Inc., and Halliburton Energy Services Inc.

Travis Curry, a resident of Mobile County, Alabama, claims that exposure to toxic substances from the infamous 2010 oil spill has caused him severe health issues. According to the filing, Curry was exposed to hazardous chemicals and dispersants while engaging in recreational activities such as fishing and working as a roofer/contractor in areas affected by the spill. He alleges that this exposure led to his diagnosis of Multiple Myeloma and other debilitating conditions. The lawsuit references previous findings by Judge Barbier that held all defendants liable under general maritime law for their roles in the disaster.

The complaint outlines how BP Exploration was designated as a "responsible party" by the U.S. Coast Guard and had contractual obligations with Transocean Holdings for drilling operations at the Macondo Well. It also details how Halliburton's Sperry Drilling Services division was responsible for mudlogging personnel and equipment on the Deepwater Horizon rig. The document accuses these companies of gross negligence and willful misconduct leading up to and following the explosion on April 20, 2010.

Curry is seeking various forms of relief from the court including past and future medical expenses, lost wages, medical monitoring, punitive damages against BP Defendants specifically for gross negligence, and compensation for physical pain and suffering among other damages. The lawsuit also highlights BP's failure to provide adequate warnings about the dangers posed by crude oil and chemical dispersants used during cleanup efforts.
