Chad Cunningham has filed a lawsuit against Konitra Jack, accusing her of violating his constitutional rights through the actions of Region 6 IV-D Agency. The complaint was lodged in the United States District Court for the Eastern District of Louisiana on September 26, 2024. Cunningham alleges that Jack, in her capacity as Director of Region 6 IV-D Agency, engaged in activities that circumvented constitutional protections and deprived him of several fundamental rights.
According to Cunningham's complaint, he asserts that Jack's agency operated as a business for profit under federal regulations, which led to violations of his First Amendment right to freedom from compelled association, his Fourth Amendment right to privacy, and his Fifth and Fourteenth Amendment rights to due process. He claims that the agency's practices subjected him to slavery and involuntary servitude by converting him into a "non-custodial parent" without his consent. The plaintiff argues that these actions were part of a premeditated plan by Jack and her agency to exploit federal child support enforcement mechanisms for financial gain.
Cunningham further accuses Jack of colluding with various judicial entities and law enforcement officials to enforce coercive collection practices against him. He contends that this collusion resulted in violations of the separation of powers doctrine and deprived him of his Seventh Amendment right to a trial by jury. Additionally, he claims that false advertisements regarding child support services misled him and others about the true nature and intent of the IV-D program.
In seeking redress from the court, Cunningham demands compensatory and punitive damages totaling $11 million for the alleged violations of his constitutional rights. He also requests injunctive relief to prevent Region 6 from advertising itself as a state child support enforcement agency and seeks termination of any IV-D services imposed upon him without consent. Furthermore, he asks for reimbursement of legal fees amounting to $3,400.
The case is presided over by Judge Eldon E. Fallon with Magistrate Judge Donna Phillips Currault assisting. Chad Cunningham represents himself in this legal battle against Konitra Jack.
