Terry Landry has taken legal action against a major retail corporation following an incident that left him injured. On December 4, 2024, Landry filed a complaint in the Civil District Court for the Parish of Orleans, Louisiana, accusing Walmart Inc. of negligence after he slipped and fell in one of their stores. The case highlights concerns over safety measures in commercial establishments and the responsibilities they owe to their customers.

According to the petition filed by Terry Landry, the accident occurred on December 1, 2023, at a Walmart store located at 6000 Bullard Avenue in New Orleans. Landry alleges that while shopping, he unexpectedly slipped on an unmarked liquid substance on the floor. He claims that Walmart Inc., as the owner and operator of the property, was either aware or should have been aware of this hazardous condition. The complaint outlines several accusations against Walmart Inc., including failure to maintain a safe environment for customers, neglecting necessary safety measures, inadequate maintenance and supervision of premises, and not warning visitors about potential dangers.

Landry's petition emphasizes that he was not at fault nor contributorily negligent during the incident. Instead, he attributes his injuries solely to Walmart's negligence. The filing invokes legal doctrines such as strict liability and res ipsa loquitur to support his claims. These doctrines suggest that the nature of the accident implies negligence on part of Walmart without needing further detailed evidence from Landry.

The lawsuit seeks compensation for various damages sustained by Landry due to the fall. These include past and future physical pain and suffering, mental anguish, loss of enjoyment of life, medical expenses incurred and anticipated in future treatments, lost earnings both previously suffered and expected going forward, diminished earning capacity, and loss of consortium. In addition to these compensatory damages, Landry is also seeking legal interest from the date of judicial demand until payment is made in full along with all costs associated with these proceedings.

Representing Terry Landry are attorneys Edward J. Womac Jr. and Kyle M. Wiedemann from Law Offices of Edward J. Womac Jr & Associates LLC based in New Orleans. The case is being overseen by Judge CJB-KWR under Case ID No: 2:24-cv-02798-CJB-KWR.
